Content Usage Licence for Individual Users

This Content Usage Licence (“Licence”) applies to all individual users of any digital content accessed via www.pharmacopoeia.com, whether or not they are the original purchaser or subscriber. By accessing or using the content on this website, You agree to be bound by the terms below.
The following meanings are given to the definitions used throughout these terms and conditions:
“MHRA” means Medicines and Healthcare products Regulatory Agency, an Executive Agency of the Secretary of State for Health.
“Site” means www.pharmacopoeia.com
“Us” or “We” or “Our” means The Stationery Office Limited, a company registered in England and Wales under company number 03049649 and with our registered office at St Andrews Business Park, 18 Central Avenue, Norwich, Norfolk NR7 0HR.
“You” and “Your” means the Named User or the organisation or individual that has purchased the Subscription on behalf of the Named User.
“Named User” shall mean the sole person that shall have access to the Publication via the Account.
“Publication” shall mean the edition of British Pharmacopoeia Online that You have access to and shall also include any Bolt-Ons.
“Bolt-Ons” means the archived edition(s) of British Pharmacopoeia Online that have been superseded by updated edition(s) and/or the edition of British Approved Names that You may have access to as part of your access to the British Pharmacopoeia Online.
“Subscription” means access to the Publication that you have either purchased from us, been granted by us, or had purchased on your behalf, for the duration agreed at the time of purchase or as otherwise specified. Full details of your Subscription, including the applicable Publication and Subscription period, can be found in your user profile. If you have not registered for an account and require clarification before agreeing to this Licence, please contact us at pharmahealth@tso.co.uk.
1. Grant of Licence
You are granted a non-exclusive, non-transferable, revocable Licence to access and use the content made available on www.pharmacopoeia.com for Your personal or internal business use only. This Licence permits online viewing of the content for reference purposes only.
You should print a copy of these Terms or save them to Your computer for future reference.
These Terms are only in the English language.
2. INFORMATION ABOUT US
We host and manage the Site on behalf of MHRA.
We publish the Publication on behalf of MHRA except that European Pharmacopoeia texts and monographs are reproduced with the permission of the Council of Europe and are copyright Council of Europe (these monographs are identified in the Publication by a chaplet of stars). The Publication is a “value added” product.

3. Applicability
This Licence applies to all individuals who access the content, including:
• Purchasers;
• Authorised users under an institutional or group licence; and
• Users accessing trial or complimentary content.
4. Usage Restrictions
You must not:
• Share, distribute, or transmit any part of the content to any other person or system;
• Reproduce and or store any part of the content except where expressly permitted by Us and or MHRA in writing;
• Share any printed and or downloaded content with others, except where expressly permitted by Us and or MHRA in writing;
• Use content for any commercial redistribution, resale, or publication;
• Allow others to access the content using your credentials;
• Modify, reverse-engineer, or create derivative works based on the content;
• Use automated tools to scrape, crawl, or systematically download the content.
• Do, or permit to be done, anything that may detrimentally affect Our copyright, trademarks or any other intellectual property rights in the Publication or Site.
• Use Our and MHRA name or logo in any fashion, including but not limited to customer lists, marketing materials or lists or references without Our or MHRA written permission; and
• Be under 18 years of age to accept these terms and conditions of this Licence.
5. Duration of Obligations
Your right to access the content may be subject to time limitations depending on your Subscription. However, your obligations under this Licence, including restrictions on copying, distribution, and misuse, continue indefinitely, regardless of whether your Subscription or access period has expired.
6. Monitoring and Enforcement
We reserve the right to monitor usage for compliance and may suspend or terminate access without notice if these terms are breached.
7. Relationship with Other Terms
This Licence should be read in conjunction with the website Terms and Conditions and Terms of Sale. In the event of any conflict, the Terms and Conditions and Terms of Sale shall take precedence.
These Terms do not apply to the supply of British Pharmacopoeia Chemical Reference Substances or British Pharmacopoeia Nucleic Acid Reference Materials which are subject to MHRA’s separate terms and conditions.
8. How we use your Personal Information
We only use Your personal information in accordance with the Privacy Policy. Please take time to read the Privacy Policy, as it includes important terms which apply to You.
9. Ownership
The copyright in the Publication is owned by the Crown and managed by MHRA on behalf of the Crown except European Pharmacopoeia texts and monographs which are reproduced with the permission of the Council of Europe and are copyright Council of Europe.
You acknowledge that all intellectual property rights in the Publication throughout the world belong to the Crown, and that the aforesaid rights in the Publication are licensed (not sold) to You and that You have no rights in, and or to, the Publication and or Site other than the right to use them in accordance with these Terms.
MHRA hereby reserves all intellectual property rights in the Publication and in MHRA’s trademarks, logos, brands and domain names.
If You wish to re-use the Crown Copyright material from the Publication applications must be made in writing clearly stating the material requested for re-use, and the purpose for which it is required. 10. Our right to vary these terms
We amend these Terms from time to time. Please look at the top of this page to see when these Terms were last updated.
We may revise these Terms as they apply to Your Subscription from time to time to reflect changes in relevant laws and regulatory requirements.
If We have to revise these Terms as they apply to Your Subscription, We will (but are not obligated to) contact You to give You reasonable advance notice of the changes and let You know how to cancel Your Subscription if You are not happy with the changes. If You opt to cancel, before the Period has commenced, We will arrange a full refund of the price You have paid for the Subscription. If You opt to cancel after the Period has commenced, We will arrange a refund of the price You have paid for on a pro-rata basis in accordance with Clause. If You opt to cancel Your Subscription, You must notify Us in writing and within seven (7) days of Us telling You about the changes to the Terms as they apply to Your Subscription.
11. OTHER IMPORTANT TERMS
We may transfer and or novate without notice Our rights and obligations under these Terms to another organisation, but this will not affect Your rights or Our obligations under these Terms. We will always notify You in writing or by posting on this webpage if this happens.
You may only transfer Your rights or Your obligations under these Terms to another person if We agree in writing, and subject to us having considered and responded to Your prior written notice, to be received in advance.
You and We acknowledge and agree that We have entered into a separate agreement with MHRA under which We have been granted a licence of certain rights, including the right to licence certain rights in the Publication to You. If Our agreement with MHRA is suspended, terminates and or expires, We shall use Our reasonable endeavours to procure that MHRA assumes Our rights and obligations under these Terms, but in the event such rights are not assumed by MHRA, our obligation to You will expire on arising on such an event.
These Terms are not intended to confer a benefit on, or be enforceable by, any person who is not a party to them except as set out in these Terms except for the purpose of enabling MHRA to enforce its intellectual property rights and any other rights it has pursuant to these Terms.
Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.
Our failure to exercise or delay in exercising any of Our rights under these Terms does not constitute a waiver of such rights or remedies.
12. GOVERNING LAW AND JURISDICTION
Please note that these Terms are governed by English law. This means that the Subscription and any dispute and or claim arising out of or in connection with it will be governed exclusively by English law. You and We both agree that the courts of England and Wales will have non-exclusive jurisdiction. However, if You are a resident of Northern Ireland You may also bring proceedings in Northern Ireland, and if You are a resident of Scotland, You may also bring proceedings in Scotland.
